PABLO MARQUEZ, sworn and saith......

Am a cook. Now keep a Barber's shop, Carnarvon Street. Wednesday night after supper had a bath and went to Mrs. Gonzales. It was after 7 p.m. all door were shut so I came back past "Weld Club Hotel", the big Mrs. call out to me "Hows business" I say very quiet, then she call me have a drink. I have one, three of us, me and Mrs. and the old man. Stop inside when I shout in few minutes. While drinking the deceased come in I ask him have a drink he had one whiskey - then he went out of door, I went out another door saw the Professor - with long hair - play few shots, I go away myself straight home Carpio place, this was about 8.30 p.m. but did not notice. At 9 p.m. saw deceased sitting on billiard saloon verandah. I went straight on to Mr. Neil's - shypoo shop. I heard Fabian and Storris there so I go. I and Mr. Neil play two games crib and then I say I go home. Left Storris and Fabian there, I went back to my house at P.C. (new one) In road Chis[Chi's] lane, speak to me few min. and I went on home. Got 15/- and went to play "Chu chee Chow" At old Jap house near Chis. I see Storris banking I sat down half an hour I suppose. I dont know there is no time in that place. Storris win over 20/-. I call him to shout. He said "To-morrow I shout I think pubs shut now". Storris go home and I go home too, passed billiard room, undressed and came out on to billiard room verandah. Billiard room was open. Wales come aske me where Charlie Hagen. I said I never see him. He said "We had better shut billiard room". Three men shut it and go away. I went down road to get macaroni feed. Went along path, met McRobles he shouted feed. This was next door to Liebglid's. After finish go home heard them playing Chuchee Chow at San Juan's near my place. I went and played about two hours, I think it was about 1.30 when knock off. Everyone go home then. I went to sleep. In morning when I get up make fire my kitchen saw Charlie in W. C. We said good morning. Then I go barber's shop, Saw Hagen open Billiard Room door (front). He come and ask me have a drink. I said too early. We went together to my barber's shop. He said he was going on to see Charlie Bamfield feed the horses. I knocked at my door called Lucas, he opened. I went in. He open back door Had cup in hand. I told him butcher had come in. He said it would be 7 before we could get meat. I asked if he had silver to get meat. I went front verandah again and then come in again. Saw him sitting in old bathroom at back looking at a bag. I went to him and said "What's that" He said, "Some smart man has put this here to make me look bad". I told him not belong you or me belong store. Told him not open any more. Tell put 'em away He told me better report this thing. I put them into kerosene tin under See Sing's house (empty) I then went to report to police. Saw P.C. Neagle I called him. Told him about it. He said you better see Sergeant Could not find him so went home Carpio's house. When passing Liebglid house I called out "Good morning" as the door was open. Met Charlie again he asked me come and have drink. I said I had too much trouble. Then go kitchen to cook breakfast with Lucas. Saw Simeon come in. I said, "Where have you been" He said, "he got lugger was going outside. I asked him pay my money (close up two pounds) He said he would pay before he went "out" I asked him what time he had come that morning he said early to get meat. I say "You been put anything my place" he never answer. Ask him again he never answer again only look me. He said he would come back by and bye never see him again. Sometime ago (don't know how long) he showed me piece of barroque said it was a stone. Told him it not worth half a crown. On Monday just before closing time at Roebuck Bay Hotel I saw three or four white men. Charlie was there and the deceased. Charlie called me. The Jew said, "I want speak you." He said, "Did you see anything tonight" I said, "No" He said he was waiting for a "big thing" now. I said "Good luck to you["] Hagen was waiting. He and I went to Billiard Room verandah. Asked me for money I owed. I said to-morrow. Then went macaroni house. Was eating when Jew came. I said "How you got on" he said "He take me long way and show me only piece of barroque he reckon he got big thing which he bring to-morrow" Told him I'd seen the barroque too. I know that man. He said it's a big Jap man with a Jap cap on. I went home, he too. This was about 11.30 p.m. Monday. I told him the man no Japanese. At Hotel I told him I had seen something but no good.
